Wow! Knowing the EPA as I do this must be a "gross" violation and I mean that literally and figuratively as well. The EPA which is understaffed and underfunded (cut by Bush) never institutes harsh penalties unless the situation is life threatening.
IIRC there are two more layers of appeal that they can go through. With enough lawyers they can stretch this out to the end of the useful life of the generating station, then sell it to someone else without ever doing anything about it. The new owner would start the process all over again.
